Terms and conditions

Definitions

BubblyDooBubbly-Doo BV, with company seat at Sint-Pietersvliet 7, 2000 Antwerpen, Belgium and registered with company number 0727.776.548, RPR Antwerp, department Antwerp.

Acceptance

When placing an order, you will be asked to accept our terms and conditions and those will stay applicable to that order.

BubblyDoo reserves the right to amend our published terms and conditions at any time without prior notice, provided that it is in accordance with the law. BubblyDoo will publish a “latest updated at” date in this document.

Price

Prices stated on BubblyDoo on European and Canadian websites are inclusive of VAT, and exclude sales tax in the United States. Shipping charges and possible sales tax will be added to this price on the checkout page.

Transfer of title

Title to the book or product will be transferred only when BubblyDoo has received full payment. After transfer of title, BubblyDoo retains the right to use photographic depictions of the product for internal use and limited external use.

Complaints

Personalization mistakes

BubblyDoo cannot be held liable for personalization mistakes that were not corrected in writing by the customer before the order was sent to the printing facility or fulfillment center. This is usually within 12 hours after payment, but might be shorter.

It is therefore very important that the customer informs BubblyDoo of personalization mistakes as soon as possible.

If it turns out that the delivered item has flaws or errors, the customer must file a complaint about that within a reasonable term.

Differences between the shown and received product

The colors, hairstyles, skin colors, etc. may look different on screen than they do in reality in print. As screens are all calibrated differently, this cannot be considered to be an error and, consequently, cannot be used as a basis for a complaint.

Differences in specifications can be used as a basis for a complaint.

Timeline

If it is confirmed that BubblyDoo can be held liable, BubblyDoo will try to find a solution in the shortest term possible.

Complaints can be filed for up to 2 years (in the EU, this term is set by European consumer protection legislation) or a longer term according to the law in your jurisdiction.

Error on BubblyDoo’s side

If BubblyDoo confirms that an error has been made on their side, a new product will be sent free of charge.

Rights of the customer

In case of an error on BubblyDoo’s side, the customer is entitled to a resolution. Multiple resolution are possible, including:

When the error is minor, BubblyDoo can propose the following resolutions, which may be rejected by the customer:

BubblyDoo can propose a resolution when it detects an error itself.

The customer must report an error within two months of detecting the error to be entitled to a resolution.

Liability

BubblyDoo is not liable for consequential losses, lost profit, or other indirect losses, including losses ensuing from the customer’s legal position towards third parties, in case of a delay in delivery or a product error.

The limitation of BubblyDoo’s liability does not apply in case of personal injury or damage to private property due to a faulty product, if the damage is due to a mistake made by BubblyDoo or a person for whom BubblyDoo is responsible.

Security

All user information is handled according to industry standards. All information sent through the website is encrypted with HTTPS.

Delivery time

Delivery will be made according to the timing communicated on the checkout page. A delay will be considered to be significant if the time from ordering to delivery is extended to over 30 days. In that case, the customer will be entitled to cancel their order and claim a refund. If the delay in shipping is due to a force majeure situation or due to delays caused by external suppliers and third parties, the customer will not be entitled to cancel the order or claim a refund. Therefore, BubblyDoo cannot be held liable for force majeure or delays caused by external suppliers and third parties.

Delay in delivery

BubblyDoo cannot be held responsible for delays in delivery due to the carrier.

Incorrect delivery address

BubblyDoo cannot be held responsible for undelivered or misdelivered items due to an incorrect or insufficiently specified delivery address.

Delivery tracking

When possible, we will send you a track and trace number on shipment.

Return is not possible

Due to the personalized nature of BubblyDoo products, you cannot return any personalized products to BubblyDoo.

You can return non-personalized products within 14 days of delivery.

Returning your order is unfortunately not possible as all products are personalized. Orders cannot be cancelled. We therefore strongly recommend that you check your details carefully before submitting your order.

Order confirmation email

When you place an order, you will receive a confirmation email within one business day. This will normally be directly after ordering.

Cancellation and right of withdrawal

Due to the personalized nature of BubblyDoo products, you cannot cancel orders after they have been sent to our printing facility. Therefore the customer does not have the right of withdrawal for our personalized products.

For non-personalized products, you cannot cancel an order if it has been shipped out and the right of withdrawal is applicable.

We recommend that you contact us as soon as possible in the event of an incorrect order.

Cancellation after the order has been sent to our printing facility is only possible in case of force majeure.

Alternative dispute resolution

This section is applicable only for customers in the EEA.

If you have a dispute with us and cannot resolve it with us directly, you can choose to use the Online Dispute Resolution Platform (ODR Platform) from the European Commission. You can access it at the following link: http://ec.europa.eu/consumers/odr/

Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of Belgium. Any disputes relating to these terms and conditions shall be subject to the jurisdiction of the courts of Belgium.

Severability

If any provision in these terms and conditions is, for any reason, held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality or unenforceability will not affect the other provisions of these terms and conditions. These terms and conditions will be construed as if such invalid, illegal or unenforceable provision had never been contained herein.

During the online order process, you will be asked to accept these terms and conditions. A checkbox linking to these terms and conditions will indicate your acceptance. If the box isn't checked, you will not be able to continue with the order.
